Bad Faith Practices in California

Insurance companies must perform certain duties for their customers under California law. When these companies fail to meet said duties, they can be found as operating in bad faith.

Some examples of these bad faith practices include, but are not limited to:

  • Misrepresenting important facts or insurance policy provisions
  • Failing to acknowledge and respond promptly to questions about a claim
  • Failing to conduct prompt investigations for claims under a policy
  • Attempting to settle a claim for less than the amount to which someone would reasonably think they were entitled based on advertising material, etc.
  • Failing to inform an insured client that a payment has been made
  • Delaying the investigation or payment of claims by requiring repetitive paperwork and documentation
  • Failing to provide a reasonable explanation for the denial of a claim or for the offer of a compromise settlement
  • Advising a claimant not to obtain the services of an attorney
  • Misleading a claimant about the statute of limitations (deadline for filing a claim)
  • Delaying the payment of hospital, medical, or surgical benefits

Suing an Insurance Company for Bad Faith in California

If an insurance company acts in bad faith, the insured person can sue and recover any or all of the following:

  • The benefits they should have received
  • Compensation (for their distress, inconvenience, frustration, anger, etc.)
